Terms & Conditions
By booking with Kwezi Adventures Ltd (“Kwezi Adventures”, “we”, “us”, “our”), you (“Client”, “you”) agree to be legally bound by these Terms & Conditions.
1. Booking & Confirmation
Who is bound?
The person making a booking does so on behalf of themselves and all travellers under their authority, and warrants they have full authority to accept these Terms on behalf of all travellers. All are bound by them.Deposit & Payment Timelines
A non‑refundable deposit of 30% of land arrangements (plus full payment for gorilla/chimpanzee permits and air travel, if applicable) is required to secure your booking.
The full balance, along with permits and airfare, is due no later than four (4) weeks (28 days) before arrival in Uganda. For bookings made within this period, full payment is required upon booking.
Confirmation
A booking is confirmed only once we receive your deposit (and any applicable extra payments) and issue written confirmation.
2. Payment Terms & Late Fees
Acceptable payment methods: Bank transfer, mobile money, Visa/MasterCard, or as agreed. All transaction charges are on the Client.
Interest of 2% above Kwezi’s bank prime rate will be charged on any unpaid overdue balances from due date until settled.
3. Cancellation & Refund Policy
By You (Client)
42+ days before arrival: Retain deposit, refund of excess funds (excluding gorilla/chimp permits and airfare).
30–41 days before arrival: Deposit retained + 40% of land arrangements + non‑refundable permits/airfare.
15–29 days before arrival: Deposit + 65% of land arrangements + non‑refundable permits/airfare.
Less than 15 days or no-show: 100% of all arrangements (land, permits, airfare) is forfeited.
By Us (Kwezi Adventures)
We reserve the right to cancel due to force majeure (e.g., natural disasters, civil unrest, epidemics). You will receive a full refund of amounts paid to us, excluding non‑refundable permits/airfare. No further claims may be made.
Other Cancellation Terms
Airlines, permit agencies, or third-party suppliers may impose additional fees—these will be borne by the Client.
No refunds for unused accommodations or activities due to causes within or beyond the Client's control.
4. Tour Inclusions & Exclusions
Included: Accommodation, ground transport, park permits/fees, guides, and only specifically listed activities.
Excluded: International/domestic flights (unless specified), travel insurance, visas, tips, unlisted meals, optional activities, personal expenses.
5. Sustainable & Responsible Travel
We champion ecotourism and responsible travel, aligned with conventional conservation best practices. Clients must respect local cultures, wildlife, and the environment.
6. Insurance Requirements
Travel insurance covering: medical expenses, evacuation, trip cancellation, personal liability, and baggage loss is compulsory. You are responsible for obtaining and providing proof.
7. Client Responsibilities
Disclose any fitness issues or pre-existing medical conditions.
Ensure valid travel documents (passport, visas, health certificates). We may assist but accept no liability for your failure.
Comply with our and third-party providers’ instructions, misconduct may result in removal without refund.
Secure personal belongings, Kwezi is not responsible for loss or theft.
8. Itinerary Changes & Variations
We retain the right to adjust any itinerary details due to weather, emergency, safety, permits, etc. Changes deemed not materially different from the confirmed itinerary are not grounds for cancellation.
Surcharges may apply if group sizes fall below minimums; if extra costs are refused, we reserve the right to cancel and refund.
9. Liability, Risk & Indemnity
You acknowledge inherent risks in adventure travel (e.g., wildlife, remote locations) and participate voluntarily.
Kwezi Adventures and its affiliates are not liable for injuries, loss, delay, illness, or death, except due to gross negligence.
You waive all rights to claim and indemnify us against any losses or claims arising from your actions.
10. Force Majeure
Neither party is liable for failure or delay caused by events beyond their control (e.g., war, strikes, natural disasters, govt actions).
11. Complaints & Dispute Resolution
Report issues during the tour to your guide or company rep for prompt resolution.
Submit written complaints within 30 days after tour's end.
All disputes are governed by Ugandan law and subject to Ugandan jurisdiction.
12. Acting as Agent & Third-Party Suppliers
We may act as agent for services booked (e.g., airlines, lodges, ground operators). We do not accept liability for services provided by such third parties claims must be made directly to them.
13. Entire Agreement & Amendments
This document, along with the booking form and confirmation, constitutes the entire agreement.
No variation or waiver of terms is valid without written consent from us and you.
14. Data Privacy
We collect only necessary personal data, which we use solely for service delivery and legal compliance.
Your data will not be shared without consent, except as legally required.
